Terms of Service
Acceptance of Terms
By accessing or using Waitwise, you agree to these Terms of Service. If you do not agree, do not use the service.
Description of Service
Waitwise may place calls to third-party organizations at your request, wait on hold, notify or call you when a representative becomes available, and facilitate a connection between you and that representative. Waitwise is an independent service and does not control the organization you are trying to reach.
No Government Affiliation
Waitwise is not affiliated with, endorsed by, or operated by the Internal Revenue Service, the United States government, or any company, agency, or other third-party organization that may be reached through the service.
User Responsibilities
You are responsible for providing an accurate phone number, remaining available when your call is ready, supplying identity verification or sensitive information directly to the third-party representative, and complying with applicable laws and third-party requirements.
Do not provide Waitwise with Social Security numbers, IRS authentication information, PINs, passwords, or similar sensitive credentials. Waitwise does not currently need that information to provide its hold and connection service.
Calls and Communications
By requesting the service and providing a phone number, you authorize Waitwise to place service-related calls to that number as reasonably necessary to provide the hold and call-connection service you requested.
SMS hold updates, scheduled-hold reminders, service-opening alerts, and call-in instructions are optional and require separate affirmative consent. SMS consent is not a condition of purchase or use of the hold service. Message frequency varies, up to four messages per request. Message and data rates may apply. Reply STOP to cancel or HELP for help. Marketing messages, if ever offered, require separate consent.
Third-Party Services
Waitwise does not control third-party hold times, representative availability, disconnections, government or company telephone systems, or the information and decisions provided by third-party representatives.
No Guarantee of Connection
We cannot guarantee that a representative will answer, an estimated wait will be accurate, a call will remain connected, you will join before a representative disconnects, or the third party will resolve your issue.
User Availability
When a representative becomes available, Waitwise either places one call to your verified number or sends one text instructing you to call in, depending on the connection method you selected. You must connect before the displayed reservation window ends. If you do not, the representative call is released and your queue entry is marked missed. Waitwise does not retry automatically. You must explicitly rejoin at the back of the queue before Waitwise will call or text you again.
Fees and Payment
Certain services may currently be offered without charge. Waitwise may charge for services in the future, but applicable pricing and payment terms will be disclosed before purchase.
Acceptable Use
You may not use Waitwise for unlawful activity, harassment, fraudulent impersonation, disruption or abuse of third-party phone systems, automated abuse of Waitwise, or attempts to evade access restrictions or legal requirements.
Intellectual Property
The Waitwise website, software, branding, and original content are owned by Waitwise or its licensors and are protected by applicable intellectual-property laws. These Terms do not transfer ownership of those materials to you.
Service Availability and Changes
The service may experience downtime and may be modified, suspended, or discontinued. We may change features as the product develops.
Disclaimer of Warranties
Waitwise is provided on an “as is” and “as available” basis. To the extent permitted by law, we disclaim warranties that the service will always be available, uninterrupted, accurate, or suitable for every purpose.
Limitation of Liability
To the extent permitted by law, Waitwise and its operators will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of the service, including delays, missed calls, lost connections, or third-party conduct. Nothing in these Terms excludes liability that cannot legally be excluded.
Indemnification
You agree to indemnify and hold Waitwise and its operators harmless from claims, losses, and reasonable costs arising from your unlawful misuse of the service or material violation of these Terms.
Termination
We may restrict, suspend, or terminate access when reasonably necessary to address abuse, security risks, unlawful conduct, or violations of these Terms.
Governing Law
These Terms are governed by the laws of the State of California, without regard to its conflict-of-law principles.
Changes to These Terms
We may update these Terms as the service changes. The effective date above identifies the current version. Continued use after an update constitutes acceptance of the revised Terms.
